NCID Charged Two 2019 NGE Candidates for Allegedly Breaching Electoral Act

The Police National Criminal Investigation Department (NCID) is starting to charge candidates of the 2019 National General Election who failed to submit their statement of account.  

NCID Supervising Director Superintendent Michael Bole says, two accused candidates were already charged with Election Expenses and Donation under the Electoral Act.

“This happened after two candidates were charged early this week.

The two accused candidates had already appeared in court with a charge of  Election Expenses and  Donation, contrary to section 125 (2) as read with section 69 (1) (a), (b) and section 107 (1) (b), (2) of the Electoral Act 2018 and section 9A(1) as Electoral (Amendment) Regulation 2019,”Superintendent Bole says.

He says, the penalty for breaching section 69 of the Act is 20-thousand dollars or two years imprisonment or both.

“The penalty for breaching section 69 as stipulated in the offence under section 125 (2) is $20,000.00 penalty units or two years imprisonment or both.”

He explains, the enactment of the Act has strengthened the functions of the Electoral Commission to deal with all election related complaints.

Under the Act,  accounts must be submitted to the Commission 90 days after the declaration of result.

Meanwhile, other candidates are yet to be charged for failing to comply with similar electoral requirements.
