
Daniel Suidani: Court Ruling Shows Limits of Administrative Decisions

The former Premier of Malaita province, Daniel Suidani said the recent Court’s decision on his case against the former Minister of Provincial Government, Hon Rollen Seleso shows that administrative decisions have limits.
This comes after the High Court ruled that Seleso’s decision in the case to disqualify him from his provincial seat in 2023 was not made according to the law.
He told SIBC News that the Court’s decision shows certain administrative decisions could be challenged in court.
“What I see with this case is a way to show to the country that there’s a justice system that is still uphold and I would like to thank the Judge, lawyers including the one I engage, Gabriel Suri, not forgetting Malaitans who have stand to see that democracy is still alive,” he said.
The former premier explains the case reflects the importance of leaders being responsive to the will of the people.
He said the ruling sets a precedence where it would not always be wise to follow what authorities say if there’s a belief that something is not right and it is better to prove that in the court of law.
Mr Suidani added he is liable to be reimbursed with all the entitlements including salaries, allowances and the court’s expenses.
“The court has stipulated clear that they have to pay my entitlements, salaries, allowances and anything that is payable to members at that time plus all the cost I bared to run this court case and that includes transport, accommodation, fees and charges that I met. I do not want this to happen but the court decided on that for me,” he said.
SIBC understands, the government’s legal team is now reviewing the High Court judgment with the intention to appeal.
